JAMESTOWN CITY COUNCIL REGULAR MEETING, MAY 2, 2022 UNOFFICIAL MINUTES The regular meeting of the City Council was called to order by Mayor Heinrich at 5:00 P.M. The Pledge of Allegiance to the flag was recited. Roll Call showed the following members present: Mayor Heinrich, Council Members Kamlitz, Steele, Buchanan and Schloegel, City Attorney Ryan, and Deputy City Auditor Sveum. Absent: City Administrator Hellekson. Consensus of the City Council was to move the Executive Session to the end of the meeting. Council Member Buchanan moved to approve the minutes of the regular City Council meeting April 4, 2022, the Board of Equalization meeting April 12, 2022, the special City Council meeting April 26, 2022 and the committee meetings April 19 and 21, 2022. Seconded by Council Member Schloegel. Unanimous aye vote. Carried. No bids were received for the sale of abandoned/impounded vehicles. Council Member Kamlitz moved to approve the following consent agenda items: A. Resolution to approve the requests for gaming site authorizations for the period July 1, 2022 through June 30, 2023, for the following: 1) James River Aerie #2337 FOE for Frontier Fort Bar & Grill; 2) Knights of Columbus for the Knights of Columbus, Corner Bar, Fred’s Den, Tapps Lounge, Jonny B’s Brickhouse and Hidden River Acres; 3) North Dakota Buffalo Foundation, Inc. for the Elks Club; 4) Progress Enterprises for Office Bar, Shady’s, Buffalo Bar & Lounge and IDK Bar & Grill; 5) Vet’s Club, Inc., for the All Vets Club. No one appeared to comment, but a telephone request was received at City Hall from Dean Hafner on April 28, 2022, that the property owner wishes to hold the public hearing and the vote at a later date as the property owner has hired an attorney who is not prepared to comment at this time. Council Member Buchanan moved to schedule the public hearing at the June 6, 2022 City Council meeting. Seconded by Council Member Schloegel. Unanimous aye vote. Carried. Ordinance No. 1560, introduced by Council Member Kamlitz, to amend and re-enact Sections 22-17, 22-17.1 and 22-17.2 pertaining to sale of tobacco products, had its second reading. Ordinance No. 1561, introduced by Council Member Schloegel, to amend and re-enact Section 5-6 pertaining to persons under twenty-one years of age prohibited from using alcoholic beverages or entering licensed premises; penalty, had its second reading. Council Member Steele moved a Resolution to approve and enter into Amendment #2 on the Jamestown Downtown Façade Improvement Project (Instrument No. 4455-SL18-MS) with the North Dakota Department of Commerce for an Environmental Review and extend the time line of the award to December 31, 2022, and authorize the Mayor to sign Amendment #2. Seconded by Council Member Buchanan. Roll Call No. 9 showed: 5 ayes, 0 nays, 0 absent. Carried. Council Member Schloegel moved a Resolution to approve the 2022 Equipment Rental Rate Schedule. Council Member Steele moved a Resolution to approve a request from Jamestown Hockey Boosters for a site authorization to conduct gaming at the Wilson Arena located on University of Jamestown campus for November 1, 2022 through February 20, 2023. Seconded by Council Member Kamlitz. Roll Call No. 11 showed: 5 ayes, 0 nays, 0 absent. Carried. Council Member Steele moved a Resolution to approve a request from Jamestown Hockey Boosters for a site authorization to conduct gaming at the Gladstone Inn (Conference Rooms) on February 3, 2023. Seconded by Council Member Schloegel. Roll Call No. 12 showed: 5 ayes, 0 nays, 0 absent. Carried. Mayor Heinrich stated the purpose of the Executive Session is for the City Council to consult and discuss with an attorney, risks and negotiating strategy in a legal matter, which discussion in public would have an adverse fiscal effect on the City’s litigation position. The legal authority for closing this portion of the meeting is North Dakota Century Code Sections 44-04-19.1 and 44-04-19.2. Mayor Heinrich stated the Executive Session is closed to the public under N.D.C.C. Sec. 44-04-19.1 and 44-04-19.2 in pending litigation including Civil No. 47-2022-CV-00209, Scot Nething; Civil No. 47-2022-CV00210, Benjamin J. Nordquist; and Hospital Services, Inc. and the Executive Session would be recorded as required by North Dakota Century Code 44-04-19.2 Subsection 5, by electronic, audio or video means, and retained for a minimum of six months after this date, and will not be available to the public. Council Member Buchanan moved a Resolution to convene the Executive Session to consult seek advice from legal counsel in pending litigation, which discussion in public would have an adverse effect on the City’s position. Seconded by Council Member Steele. Roll Call No. 13 showed: 5 ayes, 0 nays, 0 absent. Carried. The Executive Session convened at 6:13 pm, on May 2, 2022 under North Dakota Century Code 44-04-19.1 and 19.2. The following attended the executive session: Council Members Kamlitz, Steele, Buchanan, Schloegel, Heinrich, City Attorney Ryan, Deputy City Auditor Sveum, Police Chief Edinger, Building Inspector Tom Blackmore (by phone), and Engineering Techician Tyler Michel. The Executive Session concluded at 6:44 pm. Council Member Kamlitz moved a Resolution to proceed as follows: 1. That legal counsel take no action on Civil No. 47-2022-CV-00209, Scot Nething;2. That the City Administrator should contact NDIRF to request that NDIRF represent the City of Jamestown in Civil No. 47-2022-CV00210, Benjamin J. Nordquist, and if NDIRF declines, the City Attorney will represent the City of Jamestown; and 3. That City Attorney will handle the Hospital Services, Inc complaint. Seconded by Council Member Buchanan. Roll Call No.14 showed: 5 ayes, 0 nays, 0 absent. Carried. Council Member Schloegel moved to adjourn at 6:50 p.m. Seconded by Council Member Kamlitz. Here are the average annual percentage rates (APR) today on 30-year, 15-year and 5/1 ARM mortgages:

The average APR for the benchmark 30-year fixed-rate mortgage fell to 5.28% today from 5.36% yesterday. This time last week, the 30-year fixed APR was 5.45%. Meanwhile, the average APR on the 15-year fixed mortgage is 4.63%. This same time last week, the 15-year fixed-rate mortgage APR was at 4.75%. Rates are quoted as APR.

The average APR on the 30-year fixed-rate jumbo mortgage is 5.21%. Last week, the average APR on a 30-year jumbo was 5.34%. The average APR on a 5/1 ARM is 4.83%. Last week, the average APR on a 5/1 ARM was 4.91%.

Experts are forecasting that the 30-year, fixed-mortgage rate will vary from 4.8% to 5.5% by the end of 2022.

While mortgage rates are directly impacted by U.S. Treasury bond yields, rising inflation and the Federal Reserve’s monetary policy indirectly influence mortgage rates. As inflation increases, the Fed reacts by applying more aggressive monetary policy, which invariably leads to higher mortgage rates.

“The pressure to contain inflation will grow and the Fed will have to raise its fed funds rate eight to 10 times with quarter-point hikes this year,” says Lawrence Yun, chief economist and senior vice president of research at the National Association of Realtors (NAR). “Additionally, the Fed will undo the quantitative easing steadily, which will put upward pressure on long-term mortgage rates.”

Here are more detailed predictions from economists, as of mid-April 2022:

  • Mortgage Bankers Association (MBA): “Mortgage rates are expected to end 2022 at 4.8%–and to decline gradually to 4.6%–by 2024 as spreads narrow.”
  • NAR’s Yun: “All in all, the 30-year fixed mortgage rate is likely to hit 5.3% to 5.5% by the end of the year. Some consumers may opt for a five-year ARM (adjustable-rate mortgage) at 4% by the end of the year.”
  • Matthew Speakman, senior economist at Zillow: “Competing dynamics suggest that there will be little reason for mortgage rates to decline anytime soon.”

Faster, easier mortgage lending

Lending has become increasingly more costly for homeowners and borrowers alike as mortgage rates continue to rise. Mortgage rates jumped 1.5 percentage points during the first three months of the year, the biggest quarterly climb in 28 years.

Higher interest rates mean higher monthly payments for borrowers. For example, on a 0,000 home with a 5.10% interest rate, the monthly mortgage payment is around ,172. This doesn’t include insurance, taxes or other loan costs. If the rate rises to 6%, the monthly payment jumps to ,398.

This means time is running out for homeowners who hope to lock in a lower interest rate by refinancing.

Mortgage rates have steadily ticked up since the beginning of March, reaching a 12-year high of 5.11% in mid-April. This is 2.14% higher than the same time last year.

The average cost of a 15-year, fixed-rate mortgage has also increased to 4.38% as of April 21, jumping 2.09% year-over-year.

And the 5/1 adjustable rate mortgage rose 3.75%, up 92 basis points from a year ago.

Mortgage rates, in general, are determined by a wide range of economic factors, including the yield U.S. Treasury bonds, the economy, mortgage demand and the Federal Reserve monetary policy.

Borrowers have no control over the wider economy, but they can control their own financial picture to get the best rate available. Typically, borrowers with higher FICO scores, lower debt-to-income (DTI) ratios and a larger down payment can lock in lower rates.

The advantage of going with a broker is you do less of the work and you’ll also get the benefit of their lender knowledge. For example, they might be able to match you with a lender who’s suited for your borrowing needs, this could be anything from a low down payment mortgage to a jumbo mortgage. However, depending on the broker, you might have to pay a fee.

Applying for a mortgage on your own is straightforward and most lenders offer online applications, so you don’t have to drive to an office or branch location. Additionally, applying for multiple mortgages in a short period of time won’t show up on your credit report as it’s usually counted as one query.

Finally, when you’re comparing rate quotes, be sure to look at the APR, not just the interest rate. The APR reflects the total cost of your loan on an annual basis.

Another important consideration in this market is determining how long you plan to stay in the home. People who are buying their “forever home” have less to fear if the market reverses as they can ride the wave of ups and downs. But buyers who plan on moving in a few years are in a riskier position if the market plummets. That’s why it’s so important to shop at the outset for a realtor and lender who are experienced housing experts in your market of interest and who you trust to give sound advice.

The interest rate is the cost of borrowing money whereas the APR is the yearly cost of borrowing as well as the lender fees and other expenses associated with getting a mortgage.

Locks are usually in place for at least a month to give the lender enough time to process the loan. If the lender doesn’t process the loan before the rate lock expires, you’ll need to negotiate a lock extension or accept the current market rate at the time.

Even if you have a lock in place, your interest rate could change because of factors related to your application such as:

  • A new down payment amount
  • The home appraisal came in different from the estimated value in your application
  • There was a sudden decrease in your credit score because you are delinquent on payments or took out an unrelated loan after you applied for a mortgage
  • There’s income on your application that can’t be verified

Talk with your lender about what timelines they offer to lock in a rate as some will have varying deadlines. An interest rate lock agreement will include: the rate, the type of loan (such as a 30-year, fixed-rate mortgage), the date the lock will expire and any points you might be paying toward the loan. The lender might tell you these terms over the phone, but it’s wise to get it in writing as well.

First, start by comparing rates. You can check rates online or call lenders to get their current average rates. You’ll also want to compare lender fees, as some lenders charge more than others to process your loan.

Thousands of mortgage lenders are competing for your business. So to make sure you get the best mortgage rates is to apply with at least three lenders and see which offers you the lowest rate.

Each lender is required to give you a loan estimate. This three-page standardized document will show you the loan’s interest rate and closing costs, along with other key details such as how much the loan will cost you in the first five years.

Borrowers can get preapproved for a mortgage by meeting the lender’s minimum qualifications for the type of home loan you’re interested in. Different mortgages have different requirements. For example, a conventional mortgage usually has higher credit score and down payment requirements than government loans, such as Federal Housing Administration (FHA) and Veterans Affairs (VA) mortgages.

The most important task for a prospective homeowner seeking a preapproval letter is to gather all the financial paperwork needed to give the lender a solid picture of your income, debts and credit history. This information helps underwriters estimate how much of a loan you can afford and the costs of the loan.

The preapproval process will cover:

  • Stable income. You’ll be expected to provide recent pay stubs, often the last two pay periods, that indicate how much you make and prove employment.
  • Total assets. Your bank statements and investment accounts will provide a larger picture of how much money you might have available to cover your mortgage.
  • Credit. A lender will run a hard credit check to look at your current score and the last several years of your credit history. Keep in mind that mortgage lenders look at a score from all three credit bureaus, which could be different than the FICO score you see on free score checking websites.
  • Total debts. You will need to list the debts you have which helps the lender understand your DTI ratio, which is vital to determining how much of a mortgage loan you can afford.

In addition to your principal and interest payments, a monthly mortgage payment may also include several fees, like private mortgage insurance (PMI), taxes and homeowners association (HOA) fees.

Your lender will be able to provide you with a line-item breakdown of your mortgage payment. Using a mortgage calculator is an easy way to find out what your monthly payments will be. You can also look at an amortization schedule, which shows you how much you’ll pay over time.

Income is the most obvious factor in how much house you can buy: The more you make, the more house you can afford.

However, it also depends on how much of your income is already spoken for through debt payments as well as your credit score and history. The more debt you have, the less likely you will be approved for a mortgage or one at a lower interest rate. Your credit score also plays a role in that the higher your score, the better loan rate and terms you will receive.

And of course, if you have a larger down payment, it will help you in all these factors for affording a home.

At a minimum, lenders will total up all the monthly debt payments you’ll be making for at least the next 10 months Sometimes they will even include debts you’re only paying for a few more months if those payments significantly affect how much monthly mortgage payment you can afford.

Lenders primarily look at your DTI ratio. There are two types of DTI: front-end and back-end.

Front end only includes your housing payment. Lenders usually don’t want you to spend more than 31% to 36% of your monthly income on principal, interest, property taxes and insurance. For example, if your total monthly income is ,000, then your housing payment shouldn’t be more than ,170 to ,520.

Back-end DTI adds your existing debts to your proposed mortgage payment. Lenders want this DTI to be no higher than 41% to 50%. Let’s say your car payment, credit card payment and student loan payment add up to ,050 per month. That’s 15% of your income. Your proposed housing payment, then, could be somewhere between 26% and 35% of your income, or ,820 to ,450.

Mortgage points represent a percentage of an underlying loan amount—one point equals 1% of the loan amount. Mortgage points are a way for the borrower to lower their interest rate on the mortgage by buying points down when they’re initially offered the mortgage.
For example, by paying upfront 1% of the total interest to be charged over the life of a loan, borrowers can typically unlock mortgage rates that are about 0.25% lower.

It’s important to understand that buying points does not help you build equity in a property—you simply save money on interest.

Cash App For Business VS Personal Accounts

For the most part, Cash App for Business and Cash App personal accounts work similarly. There are a couple of key differences, however:

  • Receiving money with a Cash App business account has a transaction fee. A personal account does not.
  • There’s no limit to the amount of money you can receive with a verified business account.
  • You can be paid by credit card, not from another Cash App account

You can have both a Cash App business account and a personal account at the same time, but each account requires a different phone number.

Cash App For Business Fees

If you’re accustomed to peer-to-peer transaction apps being free, it may be a little disappointing to hear that Cash App for business has transaction fees in addition to the optional fees personal accounts pay for expedited bank deposits.

Here are the fees for Cash App business accounts:

  • 2.75% per transaction
  • 1.25% fee (minimum .25) on instant deposits

But wait, aren’t transactions free with a personal account?

Cash App for business is less about getting unique features than about being in compliance with your terms of service. More importantly, as of 2022, services like Cash App are required to report commercial transactions totaling more than 0 in commercial payments annually to the IRS. You should expect greater scrutiny of transactions going forward.

Cash App Business Account Limits

Given its origins in P2P transactions, Cash App wasn’t envisioned as a high-volume transaction platform. To use Cash App for more than just an occasional small sale, you’ll need to get a verified account. The limits work like this:

  • ,500 sending limit a week and ,5000 per month with a verified account.
  • There is no limit on the amount you can receive.
  • ,000 per week limit on cashouts
  • Unverified accounts can do 0 worth of transactions a day and ,000 within a 30-day period

You can access limits within the app by tapping on the account setting icons in the upper right corner, then tapping on Limits.

How To Make A Cash App Business Account

Creating a Cash App business account is pretty easy.

  1. Download Cash App and create a personal account.
  2. Within the app, tap the icon in the upper right corner that looks a bit like a person. This will bring up your account information.
  3. The top submenu should say “Personal.” Tap on that. You’ll find your personal details there. Scroll all the way to the bottom and you should see the option to Change Account Type. Tap on that.
  4. If you’re in the right spot, you should see something like the screenshot below, which discloses the transaction fee. Tap on Change This Account.
  5. Accept the confirmation
  6. If you haven’t already, you’ll want to link a bank account to your Cash App. You can do this by selecting Linked Banks and following the instructions within.

Note that you can verify your account before or after you convert your personal account to a business account.

The first time you try to exceed the limits of an unverified account, you’ll be prompted to verify your account. You’ll then be asked to submit personal information including your full name and Social Security Number.

How To Set Up & Use Cash App For Business Transactions

You don’t have to do anything special to get Cash App ready for business transactions.

Cash App works through payment links and QR codes, which means that you and other Cash App users will be able to initiate transactions by having one party scan the other’s QR code. If you don’t want to hold up your phone for every customer, you are able to print this code out for them to scan instead.

The good news is that your customers don’t have to have Cash App in order to pay you.

You can generate a payment link (your $cashtag) that you can text, email, message, or embed in your website. This link will take them to a “” page where they can either log into their Cash App or enter their name and email address along with their credit or debit card information.

Accepting Cash App Payments Without A Business Account

Cash App used to live in its own little silo apart from the rest of the Square ecosystem, but that’s no longer the case. If you use Square as your payment processor, you may be able to accept Cash App payments without a Cash App business account. Cash App is enabled as a payment method by default when you’re using a compatible Square program. This feature can be toggled off, however, if you’d prefer not to accept Cash App.

Should You Use Cash App For Business?

Cash App’s business applications are narrow but powerful.

For businesses that make infrequent and small transactions, Cash App is a wonderful convenience. You’ll be able to take Cash App and credit card transactions with minimal fuss and no hardware expenditures outside of the mobile device you’re already using. The flat 2.75% transaction fee recalls the old days of Square; with no flat markup, it’s possible to make very small transactions economically.

That said, Cash App is extremely limited. It offers the ability to take payments and that’s about it. Cash App will send you a 1099-K form if you do over ,000 in transactions in a calendar year (less if you’re based in Massachusetts, Vermont, Maryland, Washington D.C., or Illinois). Beyond that, you’re responsible for taxes and keeping track of transactions. Add in the limits for sending and cashing out money and you have a tool that just isn’t suitable for high-volume businesses.
